Today, the Supreme Court is hearing oral arguments in Anderson v. Intel Corp.
The justices will consider whether a claim that an underperforming investment plan failed to use requisite “care, skill, prudence, or diligence” and breached the duty of prudence under the Employee Retirement Income Security Act of 1974 (ERISA).
